Probate & Trust Administration
Care & Empathy in Settling Your Estate When You Die
Nothing can be more stressful and heartbreaking than the loss of a loved one.
We understand how difficult it is for you and your family when a loved one passes away. Unfortunately, the grieving process leaves little room for major decisions that are thrust upon you. Whether you have a Will, Revocable Trust, or neither, a probate or estate administration is important to your peace of mind! Probate or estate administration is a court-supervised process making sure your estate matters are settled.
The notion of “avoiding probate” is an unfortunate myth to avoid. Anyone telling you to “avoid probate” should be ignored. Why? Because, at a minimum, Probate provides your family with at least two very important benefits: clarity and certainty, at least with respect to your end-of-life creditors and your homestead! Meet with us to learn more!
Another myth we debunked is that a revocable living trust “avoids probate.” The reality is that the assets in your revocable living trust do not always and completely avoid probate. If your estate lacks enough assets to pay your debts and creditors, and you die owning a revocable living trust, your trustee (usually your loving family member) must use the assets in your revocable living trust to pay for your debts and creditors, before giving the trust assets to your trust beneficiaries!
